Terms of Use (EULA)
The short version: Kip is a personal habit-tracking app. Everything you create stays on your device. Using Kip requires a Kip Plus subscription (monthly or yearly, starting with a free trial where offered), billed and cancelled through the App Store or Google Play. Kip is a motivational tool, not medical advice, and it's provided as-is.
By downloading, installing, or using Kip (the “App”), you agree to these Terms of Use and to our Privacy Policy. If you don't agree, don't use the App. You must be at least 13 years old to use Kip.
The developer grants you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own personal, non-commercial use, subject to these terms and to the usage rules of the store you installed it from (Google Play's Terms of Service or Apple's Media Services Terms and Conditions).
You may not: reverse-engineer, decompile, or extract the App's source code except where applicable law expressly permits it; copy, redistribute, sell, rent, or sublicense the App; remove any proprietary notices; or use the App for any unlawful purpose. The App, including its design, text, graphics, and the Kip character, remains the property of the developer.
If you downloaded Kip from the Apple App Store, your licence to use the App is governed by Apple's Licensed Application End User License Agreement (the “Standard EULA”). These terms supplement it; where they conflict, the Standard EULA controls. As the Standard EULA sets out: these terms are between you and the developer, not Apple; Apple has no obligation to provide maintenance or support for the App; Apple isn't responsible for any product or intellectual-property claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Kip's features require an active Kip Plus auto-renewing subscription, offered monthly or yearly. New subscribers get a free trial where offered (currently 3 days); trial eligibility is decided by the store, not by the developer. Current prices are shown in the App before you subscribe.
Habits, check-ins, notes, and anything else you enter are yours. They're stored only on your device — the developer has no access to them and can't recover them if your device is lost or reset, or the App is uninstalled. You can export or delete them at any time from Settings. Keeping your own backups is your responsibility.
Kip offers general encouragement and suggestions based on the patterns in your own check-ins. It isn't medical, psychological, fitness, or nutritional advice, and it isn't a substitute for a qualified professional. Check with a doctor before starting a new exercise, diet, or health routine, and don't ignore professional advice because of something in the App.
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and uninterrupted or error-free operation, to the maximum extent permitted by law. Reminders depend on your device's notification settings and may not always be delivered.
To the maximum extent permitted by law, the developer isn't liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data stored on your device. The developer's total liability for any claim relating to the App is limited to the amount you paid for Kip Plus in the 12 months before the claim. Nothing here limits liability that can't be limited under applicable law, or your statutory rights as a consumer.
You can stop using the App and uninstall it at any time. These terms end automatically if you breach them, at which point you must stop using the App. Sections 5 through 8 survive termination.
If these terms change in a way that matters, we'll update the effective date above. Continuing to use the App after a change means you accept the updated terms. Questions about these terms: robertoneamtu12@gmail.com.
